Forest Champion (Monthly Donation): Terms and Conditions

These terms and conditions govern the relationship between you (the donor) and us (the National Forest Company, company number 02991970, registered charity number 1166563 “National Forest”, “us”, “we”)) in relation to your participation in our Forest Champions regular supporters’ scheme for ongoing donors (the “Champions’ Scheme”).

By confirming on the website that you wish to sign up for the Champions’ Scheme you agree to be bound by these terms and conditions (as amended from time to time) until such time as you cease your participation in the Champions’ Scheme.

1. Our Contract with You 

Your application to sign up for the Champions’ Scheme constitutes your offer to participate in the scheme on these terms and conditions (as amended from time to time) but does not constitute the creation of a contract. We have complete discretion over whether to accept such any application and reserve the right to decline to process an order for any reason whatsoever and provide a full refund. The contract between you and us will be entered into once we have accepted your application and processed and received your first donation. 

2. Donations 

You, as a participant in the Champions’ Scheme, agree to make monthly donations to us. We will use these donations at our discretion and any donations will be treated as unrestricted funding but always within our stated charitable objectives of woodland creation and management of a sustainable and connected forest, and in accordance with our Fundraising Promise. For this reason, we are unable to ring-fence donations under the Champions’ Scheme to specific funds or projects.  

All donations via the Champions’ Scheme shall be paid via Direct Debit, which will be processed via our payment services providers, Paypal or WorldPay. By confirming that you wish to participate in the Champions’ Scheme you authorise Paypal or WorldPay (or such other payment services provider as we may use from time to time) to request funds from your bank account (the details of which you will provide at the time of requesting to join the Champions’ Scheme) via Direct Debit each month. 

3. Gift Aid 

When you donate to us through our Champions’ Scheme and confirm that you are a UK taxpayer in accordance with the requirements of the Gift Aid scheme as they apply from time to time, we can reclaim Gift Aid. 

It is your responsibility to determine whether you qualify for Gift Aid and we are not able to provide any form of legal, financial or taxation advice in this regard.

4. The Benefits 

As a donor under the Champions’ Scheme, you will have access to: 

  1. A downloadable welcome pack from the National Forest thanking you for your support, which will be sent to the email address you provide when signing up for the Champions’ Scheme; 

  2. A National Forest wooden drinks coaster to acknowledge your commitment to supporting the National Forest, which will be sent to you in the post within a reasonable period from your initial sign up (within 6 weeks). Please note that the wooden drinks coaster is gifted to you by us purely to show gratitude for your ongoing support.  

  3. Occasional digital badges to acknowledge and celebrate chronological milestones of your supporting the National Forest 

  4. After 12 months of donations to the Champions’ Scheme, an opportunity to Dedicate a Tree free of charge in the National Forest may become available to donors for whom the total donations during the previous 12 month period total £75 or more. This is subject to the separate Terms and Conditions for our Dedicate a Tree product. Please note that the Dedicate a Tree is gifted to you by us purely to show gratitude for your ongoing support.
  5. regular newsletters from the National Forest informing you of what we’re up to and how your donations are supporting us to further our objectives (although you will be free to opt out of receiving these newsletters at any time); and 

  6. invitations to selected events and activities operated by us as well as those operated by third parties which are taking place in the National Forest. 

We reserve the right to vary, amend or withdraw any of the above benefits (or any other benefits which may be offered to participants of the Champions’ Scheme from time to time) at any time.   

We also reserve the right in our absolute discretion to withhold benefits from any participants for any period of time during which a regular donation has not been collected/paid.  

5. Changes to Donations 

You can request to change the amount or payment date for your donations by contacting us directly, using the contact us form. 

We will endeavour to enact any changes to your Direct Debit donations requested by you as soon as possible. However, we may not always be able to change or cancel a donation before a further payment is claimed at the previous Direct Debit amount or on the previous Direct Debit date. 

You will, at all times, have the right to opt-out of receiving newsletters, updates and other correspondence sent to you as part of your Champions’ Scheme participation. For further information regarding this please see our privacy policy. 

6. Change from our previous monthly donation scheme 

Supporters who were part of our previous monthly donations scheme have been notified that the scheme has ended and have been migrated to the new Champions’ Scheme, subject to these Terms and Conditions. 

Such supporters are no longer subject to the Terms and Conditions for the old regular donations scheme. 

7. Cancellation by you 

If you wish to cancel your participation of the Champions’ Scheme please contact your Bank and/or Paypal/WorldPay to cancel future direct debit instructions to us. You can also let us know that you are / or wish to cancel by email or telephone. 

We will endeavour to cancel your membership as soon as reasonably possible but if the cancellation is requested shortly before an upcoming Direct Debit payment date, it may not be actioned by your Bank until after that payment has been taken. In such circumstances, your cancellation will take effect from the next Direct Debit payment date. 

8. Cancellation by Us 

We may cancel our agreement with you for the provision of the donation at any time by writing to you (by post or by email) if: 

(a) you do not make a donation to us when it is due or any donation to us from you is returned, refunded or rejected by your Bank; or 

(b) you otherwise breach these terms and conditions. 

Acceptance of all donations will always remain at our discretion. 

9. Refunds 

As a registered Charity, we are subject to regulation by the Charities Commission for England and Wales under The Charities Act 2011. As a rule, Charities are not permitted to refund any donations. However, there may be exceptional circumstances. If you have any other concerns regarding your donation or a potential donation, please do contact us using the contact us form. 

10. Regulation 

The National Forest Company is registered with the Fundraising Regulator and acts at all times in accordance with the Code of Fundraising Practice. For further information on the Fundraising Regulator, please visit https://www.fundraisingregulator.org.uk/

11. General 

This contract is between you and us. No other person shall have any rights to enforce any of its terms. All personal information that you provide to us from time to time will be collected, managed and processed in accordance with our Privacy Policy. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. 

These terms are governed by English law and you can only bring legal proceedings in respect of the products in the English courts.
