Plant a Tree Events: Terms and Conditions

These terms and conditions govern the relationship between you (the purchaser) and us (the National Forest Company, company number 02991970 (“National Forest”, “us”, “we”) for the provision of our plant a tree experience (the “Experience”) to you.

1. Our Contract with You

The placing of an order by you constitutes your offer to purchase the Experience on these terms and conditions (as amended from time to time) but does not constitute the creation of a contract. We have complete discretion over whether to accept such an offer and reserve the right to decline to process an order for any reason whatsoever and provide a full refund.

The contract between you and us will be entered into once we have accepted your offer to purchase the Experience, have processed your order and have received payment.

2. The Gift

By purchasing an Experience you will be entitled to:

(a) attend one of our tree planting events (the “Event”).

The descriptions of the Experience and the Event given on our website and in any other literature are only intended to present a general idea of those items and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and us.

We cannot be held responsible for any descriptions by any third parties or on any third party or agent sites.

Please note that purchasing an Experience you are only purchasing the right to attend an Event. You will not receive or be entitled to receive any ownership rights in any of the trees planted in the National Forest.

3. The Event

Public Events - All Events will be by invitation only for the purchasers of an Experience (and their invited guests as per the allowances of the ticket purchased)

Timing & Location – All of our Events take place within the planting season (approximately November to March) and at the location specified by us at the time of placing your order (or such other location within the National Forest as we notify you from time to time).

Instructions - All attendees at such Events must follow all reasonable instructions of our staff conducting the Event and at all times behave in a civilised and appropriate manner towards other attendees. Anyone who fails to do so will be asked to leave the Event and will not be entitled to a refund.

Travel – If an Event has to be cancelled for any reason outside of our control, we cannot be held liable for any additional costs that you have incurred including (but not limited to) travel, subsistence and any other expenses.

Parking – All ticketing packages include a set allocated number of parking spaces depending on the allowances for the ticket purchased.

Clothing – We strongly recommend that all individuals attending an Event wear suitable clothing and footwear and also bring a spade with them. All clothing and footwear that you wear and spade that you bring with you to our Event (as well as those of your guests) must be clean. This is essential to ensure the protection and biodiversity of our woodlands.

Alterations – If you want to change which Event you are attending, you must let us know at least four weeks before the date of the Event you originally booked. We will try to accommodate you at an Event on another date. However, we cannot guarantee that we will be able to find a date that is suitable for you. If we are unable to provide any alternative dates within 12 months of your original booking then you will be entitled to a full refund.

If you do not give us sufficient notice of wanting to alter your booking or try to change your booking on more than one occasion, we reserve the right to refuse your request. We will not offer you a refund in these circumstances and one of our foresters will plant the tree on your behalf.

For further information on attendance at the Event, please see our Plant a Tree page.

4. Price and Payment

The price of the Experience will be the price indicated on the order page when you placed your order. This price is inclusive of VAT.

We currently accept via Paypal or WorldPay only and you will be redirected to the relevant payment website to pay for the Experience at the time of placing your order.

5. Cancellation by You

You can change your mind and cancel the purchase of the Experience for a full refund within 14 days of placing your order with us, provided that neither you nor anyone else has attended the Event that was purchased.

Please contact us as soon as possible if you are having any issues with the Certificate or if you wish to cancel your order.

6. Cancellation by Us

If we cancel an Event either before or on the day it is due to be held because of circumstances beyond our control we will notify you of the available alternative Event(s) that you can re-book to attend. If we are unable to offer an alternative date, or if you are unable to attend the alternative date offered, you will be entitled to a refund.

We cannot be held liable for any costs, including (but not limited to) travel expenses or pre-booked accommodation costs incurred by you in the event of a cancellation.

We may also cancel our contract with you for the provision of the Experience at any time by writing to you if:

(a) you do not make any payment to us when it is due or any payment to us from you is returned, refunded or rejected by your Bank; or

(b) you otherwise breach these terms and conditions.

If we end the contract for any of these reasons we will refund any money you have paid in advance for the Experience we have not provided but we may deduct or charge reasonable compensation for the net costs we incur as a result of your breaking the contract.

7. Our Liability to You

We do not exclude or limit our liability to you where it would be unlawful to do so, including:

(a) for death or personal injury caused by our negligence or the negligence of our employees;

(b) for fraud or fraudulent misrepresentation; or

Subject to the above, our total liability to you in respect of all other losses arising under or in connection with the provision of the Experience shall in no circumstances exceed the price paid for the Experience and any reasonably foreseeable losses you incur.
